These Terms & Conditions ("Terms") govern your use of the Quest Watersports website and online quote and winter services request system (together, the "Site"). The Site is operated by Riverview Enterprises LLC, doing business as Quest Watersports ("Quest," "we," "us," or "our"), located at 1851 Old Chicago Road, Ottawa, IL.
By accessing the Site or submitting information through it, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site. You are always welcome to contact us directly at (815) 433-2200.
Any quote generated through the Site is an estimate based on the information you provide. It is not a binding agreement, an offer of guaranteed pricing, or a reservation of services.
All quoted charges are subject to Quest's review and may be adjusted for measurement discrepancies, calculation errors, misapplied rates, or changes in the information provided. Storage and winter services are provided only under Quest's separate written storage agreement ("Storage Terms"), which you will review and sign before services begin. In the event of any conflict between the Site and the signed Storage Terms, the signed Storage Terms govern.
You agree that the information you submit through the Site — including your name, contact information, and details about your unit — is accurate and current, and that you are authorized to provide it. We use this information to prepare your quote, coordinate services, and communicate with you, as described in our Privacy Policy.
You are responsible for maintaining the accuracy of information you provide and for any activity conducted through the Site using your information.
Deposits or payments made through links on the Site are processed by a third-party payment provider. Quest does not receive or store your full payment card details through the Site. All Site pricing and deposit terms are estimates subject to Quest's review and to the final signed Storage Terms.
The Site is provided solely for use by Quest Watersports; Heritage Harbor Ottawa; current and prospective customers seeking quotes or services for units they own or are authorized to represent; and other parties who have Quest's express written permission. Any other use is unauthorized.
Without limiting the above, you may not access or use the Site, or any pricing, rate structure, calculations, content, or functionality within it, for any of the following purposes:
This prohibition applies regardless of whether you access the Site directly, through another person, or through any automated tool, and regardless of whether you enter accurate information.
Quest's pricing structure, rates, and methodology are the product of substantial effort and have competitive value, and the harm to Quest from unauthorized competitive use — including the exposure of its pricing structure and the unauthorized access itself — is real but difficult to quantify precisely. Accordingly, you agree that each instance in which the Site is used, in violation of this Section, to generate or inform a quote, estimate, or price for a customer or unit without Quest's consent constitutes a separate violation entitling Quest to liquidated damages of $5,000 per violation. Each distinct customer or unit quoted constitutes a separate violation; repeated pricing of the same customer and unit in a single course of conduct shall be treated as one violation. The parties agree this amount is a reasonable estimate of Quest's harm and not a penalty, and Quest is further entitled to its costs and reasonable attorneys' fees incurred in enforcement. Quest may also pursue injunctive relief and any other remedies available at law or in equity.
You agree to use the Site only for its intended purpose. You agree not to misuse the Site, attempt to gain unauthorized access to it or its underlying systems, interfere with its operation, or use it to submit false or fraudulent information.
The Site and its content — including text, layout, graphics, logos, pricing structure, and the Quest Watersports name and marks — are owned by or licensed to Quest and are protected by applicable law. You may not copy, reproduce, or reuse the Site's content without our permission, except for your own personal, non-commercial use in connection with obtaining our services.
We may update, suspend, or discontinue the Site or any part of it at any time without notice. We may also revise these Terms from time to time. The version and date shown above indicate the current Terms. The Terms in effect at the time you submit information through the Site govern that submission. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
The Site is provided "as is" and "as available." While we work to keep it accurate and functional, we do not warrant that it will be uninterrupted, timely, secure, or error-free, or that any quote or information generated through it will be free of mistakes. Pricing and other errors remain subject to correction as described in Section 2.
To the fullest extent permitted by law, Quest will not be liable for any indirect, incidental, or consequential damages arising out of your use of, or inability to use, the Site. Quest's responsibility for the storage and servicing of your property is governed solely by the signed Storage Terms, not by these Terms.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Site or these Terms shall be brought in the State of Illinois and/or the relevant local venues serving Quest's location.
